REAL ESTATE TAXES / AGRICULTURAL USE VALUATION

Is your real estate tax bill unreasonably high?  Dworken & Bernstein may be able to help.

Under Ohio law, real estate taxes are determined based upon the fair market value of your property.  Therefore, if your property is overvalued on the tax duplicate, you may be paying too much in property taxes.

A property owner may challenge their property tax bill by filing a complaint with the Board of Revision between January 1st and March 31st of each year. The attorneys at Dworken & Bernstein routinely represent residential, commercial and industrial property owners in connection with these Board of Revision proceedings who believe that the fair market value of their property shown on the tax duplicate does not accurately reflect the true fair market value of the property.

Our experienced attorneys will meet with you to determine a plan to contest your real estate tax value. We will prepare and file the required complaint and other documentation with the County Board of Revision in order to prosecute your case.  If necessary, we will consult with and retain expert appraisers in order to establish the true fair market value of your property for purposes of showing that it is less than the amount shown on the County tax records. We will attend the hearing before the Board of Revision and present evidence to support your position.  Additionally, when necessary we will appeal the decision of the Board of Revision to either the Ohio State Board of Tax Appeals or to the appropriate state court in order to reach a more favorable result for our client.

Dworken & Bernstein’s attorneys have successfully prosecuted hundreds of tax complaints that have resulted in significant tax reductions in the real estate tax bills for our clients. We have also successfully negotiated settlements of real estate tax disputes with County prosecutors, auditors and school boards that have also resulted in substantial tax savings for our clients.

Additionally, the attorneys at Dworken & Bernstein are also well versed in other tax savings measures that may be utilized to reduce your property tax bill such as the Current Agriculture Use Value, or CAUV, program. Having your property taxed as CAUV can significantly reduce your real property taxes, especially if your property is currently being taxed as a residential or commercial use.  The attorneys at Dworken & Bernstein will meet with you to determine whether your property qualifies for a CAUV designation and can also make the annual filings required to ensure that your property stays in the program.

With over 60 years of experience in assisting and advising both companies and individuals in connection with real estate tax disputes, Dworken & Bernstein is here to help navigate you through the process of getting your real estate taxes reduced.
