Bankruptcy

We'll be there to help you weather the storm.

Dworken & Bernstein represents individuals, business and commercial clients, creditors, and banks prior to and during bankruptcy proceedings. These bankruptcy cases are initiated by either an individual or by a business seeking protection from its creditors. In either case, our attorneys will look for a way to solve creditor issues without immediately resorting to Bankruptcy Court filings. In either case, we attempt to first understand the facts and help our clients understand their alternatives. We find that once our clients understand their legal position, they are able to make better practical decisions.

Individuals often find themselves buried in debt. This debt arises in various ways, including job losses and layoffs, medical issues, and divorce. In many cases the debt leaves these people depressed and the related stress can be horrible. They worry about saving their home and saving their cars. Most of all they want to know that they can get back on track financially. Chapter 7, 11, and 13 can be used to help achieve these goals.

Businesses unfortunately fail much more often than they succeed. These businesses are ultimately owned by people so invested in the business's future that the debts of the business become their debts. In other cases, business debt remains the sole problem of the business. With careful planning, the business can be saved and the business owner can work out the creditor concerns. Tough negotiation skills are critical at this juncture.

Commercial banking clients and other creditors find our firm to be practical, knowledgeable, and responsive. We typically request and review various documents, discuss the status of the debtor, research various public filings, and often work with opposing counsel to find an expedient path to recover as much money as possible for our clients. Creativity and persistence is the key to this process.

Dworken & Bernstein can help you and your company understand your legal position, determine your alternatives, and help you successfully work through the bankruptcy process.
